Common Categories of Workplace Discrimination, Harassment, and Retaliation

There are four common categories of workplace discrimination:

  • Gender

  • Racial

  • Disability

  • Age

Under California law, it is illegal to discriminate against an employee or potential employee based on these protected categories.

Gender

Racial

Racial discrimination is illegal and punishable by law. The following are examples of racial discrimination in the workplace:

Disability

Employers are required to make reasonable accommodations for an employee’s disability and/or medical condition. Disability discrimination may involve an employer’s refusal to accommodate a disability and/or medical condition.

Age

The federal Age Discrimination in Employment Act (ADEA) protects employees who are the age 40 or older. This discrimination can include termination, refusing to provide retirement benefits, refusing to hire, or reducing health benefits.
